1. Acceptance of Terms

Chicopee Concrete Company provides residential and commercial concrete contracting services, including but not limited to driveway installation, patio construction, foundation work, sidewalk building, decorative concrete, and related concrete flatwork and structural services. Services are provided in Chicopee, MA and surrounding communities as described on the Site.

All services are subject to availability, site conditions, permitting requirements, and weather. We reserve the right to decline any project that falls outside our area of expertise or service territory.

3. Estimates and Pricing

All estimates provided by Chicopee Concrete Company are free and non-binding unless formalized in a signed written agreement. Estimates are based on information available at the time of assessment and are subject to change if site conditions differ from what was observed during the initial visit - for example, undiscovered soil issues, hidden utilities, or additional material removal requirements.

If conditions arise during a project that require a scope or price change, we will notify you before proceeding. Work requiring additional cost will not begin without your written or verbal authorization.

Prices quoted do not include permit fees unless explicitly stated in writing. Permit fees charged by local municipalities are passed through to the customer at cost.

4. Scheduling and Cancellation

Once a project is scheduled, we will provide you with an estimated start date. Scheduling is subject to weather conditions, permitting timelines, and prior commitments. We will make reasonable efforts to notify you of any delays.

You may cancel a scheduled project by contacting us at least 48 hours before the scheduled start date. If materials have already been ordered or delivered for your project, you may be responsible for reasonable restocking or material costs incurred before cancellation.

We reserve the right to postpone or cancel work due to weather, unsafe site conditions, or circumstances outside our control. In such cases, we will reschedule at the earliest mutually available time at no additional cost to you.

5. Payment Terms

Payment terms will be stated in your written project agreement. Unless otherwise agreed in writing:

• A deposit may be required before work begins to cover materials and scheduling.
• The remaining balance is due upon completion of the project.
• Accepted payment methods will be specified in your agreement.

Late payments may be subject to a finance charge as allowed by applicable law. If payment is not received within 30 days of the invoice date, we reserve the right to pursue collection through lawful means, including small claims court or other legal remedies. You agree to reimburse us for reasonable costs of collection, including attorney fees where permitted by law.

6. Warranty and Workmanship

Chicopee Concrete Company warrants that all work will be performed in a professional and workmanlike manner in accordance with applicable industry standards. Any specific warranty terms will be stated in your written project agreement.

This warranty does not cover damage caused by misuse, neglect, improper maintenance, or conditions outside our control - including but not limited to extreme weather events, natural disasters, soil movement unrelated to our work, or the application of chemical deicers to new concrete surfaces.

Concrete is a natural material. Minor surface variations, hairline cracks within control joints, and color variation are normal characteristics of concrete and are not defects.

7. Customer Responsibilities

Before work begins, you agree to:

• Clear the work area of vehicles, equipment, and personal property.
• Disclose the location of underground utilities, irrigation systems, and any relevant site features.
• Ensure adequate access to the work area for our crew and equipment.
• Obtain any necessary homeowner association approvals prior to project start.

Failure to meet these responsibilities may result in project delays or additional charges.

8. Limitation of Liability

To the fullest extent permitted by law, Chicopee Concrete Company shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of this Site or from services rendered, including loss of use, lost profits, or property damage not directly caused by our negligence.

Our total liability to you for any claim arising from services provided shall not exceed the total amount paid by you to us for the specific project giving rise to the claim.

9. Warranty Disclaimer

The information and content on this Site is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. We do not warrant that the Site will be uninterrupted or error-free.

10. Dispute Resolution

If a dispute arises between you and Chicopee Concrete Company, we encourage you to contact us first at team@chicopeeconcretecompany.com or (413) 240-0179 so we can attempt to resolve the issue directly. Most concerns can be resolved through a phone call or a follow-up site visit.

If we cannot reach a resolution informally, disputes shall be resolved through binding arbitration or small claims court in Hampden County, Massachusetts, as elected by the party initiating the claim. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Chicopee Concrete Company.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Hampden County, Massachusetts.

12. Modifications to These Terms
